These Terms and Conditions govern use of www.wishcaps.com and the online services, forms, educational materials, and ordering tools made available by Wishcaps. By accessing or using the website, you agree to these Terms.
Website Information
The website provides general information about Wishcaps equipment, scalp cooling, ordering, pricing, support, and related resources. Website content is provided for general educational and business purposes. It is not medical advice, diagnosis, treatment, or a substitute for advice from your oncology team.
Separate Lease Agreement
Submitting an order does not by itself guarantee approval, shipment, or medical suitability. An equipment lease is governed by the Cold Cap Equipment Lease Agreement, accepted Order Summary, Fee Schedule, packing list, and any written addendum accepted by Wishcaps and the lessee.
If these website Terms conflict with an accepted Lease Agreement regarding equipment, payment authorization, billing, cancellation, return, damage, replacement, or enforcement, the Lease Agreement controls.
Eligibility and Accurate Information
You must be at least 18 years old and legally able to enter a contract to submit an order. You agree to provide accurate, current, and complete information and to update information that changes. You may not submit an order, signature, payment authorization, medical information, or referral on another person’s behalf unless you have lawful authority and any required permission.
Electronic Transactions
You agree that website checkboxes, typed signatures, electronic signatures, order submissions, receipts, notices, and records may be used to conduct the transaction electronically. You are responsible for maintaining a valid email address and mobile number and for saving or printing the documents provided during ordering.
Pricing and Payment
The current standard Wishcaps lease price is $325 for each 30-day period unless a different accepted patient-specific price appears in the Order Summary. Dry ice is purchased separately. Taxes, optional dry- ice delivery, expedited shipping, late charges, returned-payment charges, missing-item charges, damage charges, and complete-kit replacement charges may apply when disclosed and authorized by the Lease Agreement or Order Summary.
Prices and services shown on the website may change prospectively. A change does not apply retroactively to an accepted lease unless the lessee agrees or applicable law permits it.
Orders and Availability
Wishcaps may review, accept, decline, place on hold, or request additional information for an order. Kit availability, carrier schedules, treatment timing, destination, payment authorization, and incomplete information may affect fulfillment. Wishcaps may correct typographical, pricing, or technical errors before accepting an order and will disclose any material change requiring customer approval.
Medical Decisions and Results
Scalp cooling is not appropriate for every patient or treatment plan. You are responsible for consulting your oncology team and obtaining any treatment-center approval. Wishcaps does not guarantee hair retention, shedding level, comfort, treatment outcome, or suitability for a particular person or regimen. See the Medical Disclaimer.
Permitted Website Use
You may use the website only for lawful personal or professional informational purposes and legitimate
Wishcaps transactions. You may not:
- Use the website to violate law, infringe rights, impersonate another person, submit false information, or commit fraud.
- Attempt to gain unauthorized access to the website, accounts, systems, forms, or data.
- Introduce malware, interfere with website operation, bypass security, scrape the website at unreasonable volume, or test vulnerabilities without written authorization.
- Copy, modify, republish, sell, or commercially exploit website content except with written permission or as permitted by law.
- Use Wishcaps names, logos, photographs, instructions, or materials in a way that implies endorsement, affiliation, or ownership.
Intellectual Property
The website and its text, graphics, photographs, logos, instructions, forms, design, and other content are owned by or licensed to Wishcaps and are protected by applicable intellectual-property laws. Wishcaps grants you a limited, revocable, nonexclusive right to access and use the website for its intended purposes. No ownership rights are transferred.
Third Party Services and Links
The website may use or link to payment processors, shipping carriers, dry-ice suppliers, treatment centers, educational sources, and other third parties. Wishcaps does not control third-party services and is not responsible for their content, pricing, availability, privacy, security, statements, or performance. A link or listing does not imply endorsement, partnership, or formal affiliation.
Website Availability
Wishcaps may modify, suspend, or discontinue website features for maintenance, security, operational, or other reasons. Wishcaps does not guarantee uninterrupted or error-free website operation. If an online form is unavailable and treatment timing is urgent, call 713-853-9299.
Disclaimer of Website Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WISHCAPS DISCLAIMS WARRANTIES REGARDING WEBSITE AVAILABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND RESULTS, EXCEPT TO THE EXTENT A WARRANTY CANNOT LAWFULLY BE DISCLAIMED.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WISHCAPS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM WEBSITE USE, INABILITY TO USE THE WEBSITE, RELIANCE ON GENERAL WEBSITE INFORMATION, OR THIRD-PARTY LINKS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Liability relating to leased equipment, payments, returns, or the parties’ lease relationship is governed by the applicable Lease Agreement.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Wishcaps harmless from third-party claims, losses, and reasonable expenses arising from your unlawful website use, material violation of these Terms, infringement of another person’s rights, or submission of information or content without required authority or permission. This provision does not apply to the extent a claim results from Wishcaps’ own conduct for which liability cannot lawfully be shifted.
Governing Law and Disputes
Texas law governs these Terms without regard to conflict-of-law rules. A lawsuit concerning website use must be filed in a court of competent jurisdiction in the Texas county where Wishcaps maintains its principal place of business, unless applicable consumer law requires another venue.
Before filing suit, the complaining party will provide written notice describing the dispute and allow 10 calendar days for a good-faith attempt to resolve it, except when immediate relief is reasonably necessary to protect property, safety, or a legal deadline. Lease disputes remain subject to the accepted Lease Agreement.
Changes to These Terms
Wishcaps may update these Terms prospectively by posting a revised version and date. Continued website use after the effective date constitutes acceptance of the updated website Terms. Changes to an accepted lease are governed by the Lease Agreement and cannot be imposed retroactively except as permitted by that agreement and law.
